CBI Legal Analysis
Investor Counsel
Source of Funds and Source of Wealth
Legal and documentary preparation for Argentine processes
A citizenship by investment file must show not only where the investment money comes from, but how the applicant's wealth was built. We help clients assemble that evidence coherently, under Argentine legal standards.

Direct answer
What is the difference between source of funds and source of wealth?
Source of funds refers to the origin of the specific money used for a transaction — for example, the bank account and the sale proceeds from which the investment is paid. Source of wealth refers to how the person's overall net worth was generated over time, such as a business, employment, investments or inheritance. Argentine CBI applicants should expect both to be examined.
Key facts
- 01The announced program requires funds to be channelled through the formal financial system and contemplates source-of-funds verification.
- 02Evidence must be traceable: each step from the origin of wealth to the investment should be documented.
- 03Foreign documents generally require apostille or legalisation and certified translation into Spanish.
- 04Banks and financial institutions apply their own AML procedures; legal preparation does not replace them.
What we do
We analyse, from a legal and evidentiary perspective, the documentation available to demonstrate the lawful origin of the applicant's wealth and of the funds allocated to the investment, identify gaps, and coordinate with the client's accountants and tax advisers to complete the file.
Depending on the case, documentation may relate to:
- Business activity and shareholdings
- Sale of a company or of assets
- Financial investments and dividends
- Professional or employment income
- Inheritances and gifts
- Loans and their repayment
- International transfers and bank statements
- Tax returns in the country of residence
Traceability
Traceability means that the movement of money can be followed, with documents, from its origin to the investment. Gaps commonly arise when funds pass through several accounts or entities, when cash was involved at some stage, or when the original transaction took place many years ago. Each gap should be closed with evidence or explained.
Consistency across documents and jurisdictions
The figures and descriptions in the file must match: amounts declared to tax authorities, corporate records, bank statements and the narrative of how wealth was generated. Inconsistencies are not necessarily evidence of wrongdoing, but they need to be identified and addressed before the authorities find them.
Common issues
- Wealth held through companies or trusts without clear beneficial ownership records
- Old transactions with incomplete documentation
- Funds received from family members without documented gifts or loans
- Discrepancies between declared income and asset accumulation
- Documents not apostilled, legalised or translated
Scope and limits
Our role is legal and documentary preparation. We do not perform banking functions, issue AML certifications, or obtain financial institution approvals, and we do not guarantee the outcome of any review. Where appropriate, this work is part of a broader legal due diligence and of the citizenship by investment file.
Frequently asked questions
Can an Argentina CBI lawyer assist with source-of-funds documentation?
Yes. Argentine counsel can review the documentation, identify gaps and inconsistencies, coordinate with accountants and advisers abroad, and organise the evidence for submission. The authorities and financial institutions carry out their own verification.
What if part of my wealth was generated many years ago?
Older sources can still be evidenced, often through a combination of corporate, tax and banking records. Where original documents are unavailable, the alternatives should be analysed case by case.
Do I need to send original documents to Argentina?
Requirements depend on the procedure. Many documents can be reviewed initially as copies; originals, apostilles and certified translations are usually needed for filing.
