What does an Argentina CBI attorney do?
An Argentina CBI attorney is an Argentine lawyer who advises foreign nationals on citizenship by investment under Citizenship Law 346, as amended by Decree 366/2025. The work covers the applicant's eligibility, the legal analysis of the investment route, due diligence, source-of-funds and source-of-wealth documentation, family members, preparation of the file and representation before the competent authorities. The attorney does not grant citizenship; that decision belongs to the Argentine State.
Key facts
- 01The legal basis is Citizenship Law 346, amended by Decree of Necessity and Urgency 366/2025 to add naturalization for foreign nationals who make a "relevant investment".
- 02Decree 524/2025 established the procedure: the Agency for Citizenship by Investment Programs evaluates the application and reports to the National Migration Directorate, which decides.
- 03On 2 October 2026 the Government announced two routes: a USD 350,000 non-refundable contribution or a USD 800,000 government bond. Implementing details remain to be published.
- 04Applicants remain subject to identity, background, financial transparency and source-of-funds review. The investment alone does not confer citizenship.
- 05The validity of Decree 366/2025 is before the Supreme Court. Any investment decision should account for that legal uncertainty.
What Argentina's CBI framework involves
Argentina's citizenship by investment route is a form of naturalization. Citizenship Law 346, as amended, provides that foreign nationals who prove before the National Migration Directorate (DNM) that they have made a relevant investment in the country may become Argentine citizens by naturalization, irrespective of their length of residence. The Ministry of Economy is responsible for defining which investments qualify.
This is not a residence permit and it is not an automatic outcome of paying an amount. It is an administrative procedure in which the State reviews the applicant, the investment and the origin of the funds, and then decides. For an investor, the question is therefore not only how much to invest, but whether the investment, the documents and the applicant's profile will withstand that review.
Why Argentine legal counsel matters
A citizenship by investment file sits at the intersection of nationality law, migration law, financial transparency rules and, frequently, corporate and tax considerations in more than one country. Decisions taken before the investment — how funds are moved, which documents are obtained, how family members are treated — are difficult to correct afterwards.
Argentine counsel reads the framework as Argentine law, distinguishes what is enacted from what has only been announced, and builds a file that is consistent across jurisdictions. For clients who already work with lawyers, tax advisers or a family office abroad, Argentine counsel provides the local legal analysis those advisers need. Eligibility and legal assessment
Before any capital is committed, we review the applicant's situation against the applicable rules. The objective is to identify obstacles early, while there is still room to address them.
Depending on the case, the preliminary assessment can cover:
- Nationality, identity documents and any prior citizenships
- Family composition and which family members may be included
- Prior migration history in Argentina and elsewhere
- Background matters that could be relevant to the review
- The proposed investment route and its legal implications
- Available documents, and documents that will need to be obtained, apostilled or translated
- Origin and traceability of the funds and of the applicant's wealth
- Corporate or holding structures through which assets are held
Investment route analysis
The routes announced in October 2026 are a non-refundable contribution to the National Treasury and the subscription of a government bond created for the program. They carry different legal and financial profiles: one is a definitive contribution; the other is a security whose terms, transferability and maturity should be read in the instrument itself once published.
We analyse the legal aspects of the chosen route — the documentation required, how funds must be channelled through the formal financial system, and how the investment interacts with the applicant's wider plans in Argentina. We do not provide investment or financial advice, and we do not promise any return. Real estate purchases should not be assumed to qualify unless the applicable rules expressly provide for them.
Due diligence
Applicants should expect due diligence on identity, background, financial position and jurisdictional risk. Preparing for that review is part of the legal work: we conduct our own legal due diligence on the applicant's documents and structures so that inconsistencies are identified and explained before the file is submitted.
Source of funds and source of wealth
Identifying the money that will be invested is not enough. The file should also show, coherently, how the applicant's wealth was generated and where the specific funds for the investment come from — business activity, sale of a company or assets, dividends, professional income, inheritance, loans or financial investments.
We review that documentation from a legal and evidentiary perspective and, where useful, coordinate with the client's accountants and tax advisers abroad. More detail on our source of funds and source of wealth work.
Documentation
Foreign public documents generally need to be apostilled (for Hague Convention countries) or legalised, and documents in a foreign language translated into Spanish by a certified public translator. Civil status records, criminal record certificates, corporate documents and financial evidence each have their own formal requirements and validity periods.
We prepare a document plan at the start, so that certificates are obtained in the right order and do not expire before filing.
Family applications
The announced program contemplates applications by the spouse and children of the main applicant, with additional contributions reported for each category. Legal coordination for families includes establishing family relationships with civil status records, reviewing custody or consent documents for minors, aligning the documents of each family member, and assessing the position of adult children.
Eligibility of each family member depends on the rules in force at the time of filing. We do not assume eligibility that has not been confirmed by the applicable regulation. See Argentina CBI for families: legal considerations.
Legal representation
Where appropriate, we assist with the filing and represent the client before the Argentine authorities involved in the procedure, follow the file, and respond to document requests or legal questions that arise during processing. Juan Pablo Rojas Pascual is admitted to practise in Mendoza, the City and Province of Buenos Aires, and before the federal courts.
Coordination with foreign advisers
Many investors already have lawyers, tax advisers, wealth managers or a family office in their home jurisdiction. We act as Argentine counsel alongside them, handling matters governed by Argentine law while the client relationship and home-country advice remain with their existing advisers. This is described further on our page for lawyers and advisers.
Corporate and investment implementation
For some clients, citizenship is one part of a broader project in Argentina — establishing a company, acquiring assets or developing a business. Citizenship by investment and business investment are legally distinct, but they can be planned together. We advise on company formation and corporate structures, contracts and local representation.
How we work: the application process
- Initial consultation — objectives, personal and family situation, general features of the investment.
- Preliminary legal assessment — legal, documentary and regulatory issues to address before proceeding.
- Investment and structure analysis — the legal implications of the proposed route.
- Documentation and due diligence — personal, family, financial and corporate documents.
- Source of funds and traceability — building a coherent, legally sustainable evidentiary file.
- File preparation — under the official rules and requirements in force at the time of filing.
- Filing and representation — assistance before the competent Argentine authorities.
- Follow-up — responding to requests and monitoring the procedure.
- Ongoing counsel — corporate, contractual or residence matters connected with the client's presence in Argentina.
Consultations can be held by video call, telephone, email or WhatsApp, in English or Spanish. Clients do not need to be in Argentina to begin.
Current regulatory status
The framework is developing. The summary below separates legislation and decrees in force, regulation already issued, official announcements, matters pending implementation and court proceedings. It is updated as new instruments are published.

Decree of Necessity and Urgency (DNU)Decree 366/2025 amends Citizenship Law 346
Adds as a ground for naturalization that a foreign national proves, before the National Migration Directorate (DNM) and irrespective of length of residence, a "relevant investment" in Argentina. The Ministry of Economy defines which investments qualify. The decree also creates the Agency for Citizenship by Investment Programs within the Ministry of Economy and transfers naturalization processing from the federal courts to the DNM.

Applications are filed with the Agency for Citizenship by Investment Programs, which first assesses whether the investment meets the Ministry of Economy's requirements and then issues a reasoned report recommending approval or rejection to the DNM, which decides.
- Official announcement
Government announcementTwo investment routes announced; applications expected in Q4 2026
The Minister of Economy and the Chief of Cabinet announced a USD 350,000 non-refundable contribution to the National Treasury, or the subscription of a USD 800,000 government bond created for the program. Press coverage reported additional contributions for family members (USD 100,000 for a spouse and for unmarried children aged 18–25; USD 25,000 for minors). These figures should be confirmed against the implementing resolution once published.
- Pending implementation
ImplementationOperational application channel not yet confirmed
As of early October 2026, professional reports noted that neither a precise opening date nor an operational application channel had been officially confirmed. Detailed documentary requirements, forms and fees should be verified when published.
- Under judicial review
Court decisionsValidity of Decree 366/2025 before the Supreme Court
In June 2026 the National Electoral Chamber declared Decree 366/2025 null in an individual naturalization case and, on 24 September 2026, granted the Government's extraordinary appeal, sending the case to the Supreme Court. Other federal courts have declared provisions of the decree unconstitutional in specific cases. In Argentina such rulings generally bind the parties to each case; the Supreme Court's decision may affect how the framework is applied.

This summary distinguishes enacted rules from announcements and pending implementation. It is general information, not legal advice, and is reviewed periodically.
What is known and what remains subject to implementation
Known: the legal basis (Law 346 as amended by Decree 366/2025), the procedural architecture (Decree 524/2025), and the investment routes and amounts announced by the Government on 2 October 2026.
Subject to implementation or confirmation: the resolution formally defining qualifying investments, the operational application channel and opening date, detailed documentary requirements, forms and fees, processing timelines, and the effect of the Supreme Court's decision on Decree 366/2025. We recommend that no funds be transferred on the basis of commercial information alone, without verifying the rules in force at that moment.
Frequently asked questions
Does investing USD 350,000 automatically grant Argentine citizenship?
No. The investment is a requirement, not a guarantee. The applicant must file an application and pass the reviews carried out by the Argentine authorities, including background and source-of-funds checks. The decision belongs to the State.
Do I need to live in Argentina before applying?
The investment route is distinct from ordinary naturalization by residence. Law 346 as amended provides for naturalization by relevant investment irrespective of length of residence. The specific conditions should be verified against the rules in force when the application is filed. Compare with citizenship by residency.
Can my spouse and children be included?
The announced program contemplates the spouse and children of the main applicant, with additional contributions reported by age category. Each family member's eligibility depends on the implementing rules and on the documents available for each person.
Is the program already open for applications?
The Government announced that applications would be received during the fourth quarter of 2026. As of our last review, the operational channel and precise opening date had not been officially confirmed. See the current regulatory status above.
Can I buy property to obtain citizenship by investment?
A real estate purchase should not be confused with the investment routes specifically provided for by the program. Before investing in property with that expectation, verify that the transaction is eligible under the rules in force.
How long does the process take?
Timing will depend on the effective implementation of the program, the documentation, the checks carried out and administrative processing. We do not offer fixed timelines as a guarantee.
Can you work with my lawyer or tax adviser abroad?
Yes. We regularly coordinate with foreign lawyers, accountants, tax advisers, notaries, translators and family offices, acting as Argentine counsel on the matters governed by Argentine law.
